Article 1. Purpose and scope
The “GIC” mobile application
offers each Internet user (hereinafter “the User”) the possibility of accessing
several online partner services.
The purpose of these General
Terms and Conditions of Use (hereinafter referred to as the "GTCU")
is to regulate the terms and conditions of availability and use of the GIC web
application (hereinafter "Site(s)") by any natural person, regardless
of their location and the terms and conditions of their connection (hereinafter
"User"). These provisions apply concurrently with the Privacy Policy,
the Cookie Policy and the General Terms and Conditions of Sale.
The User is informed that he can
only benefit from the service offered by GIC on the condition of accepting,
without reservation, these T&Cs.
The T&Cs constitute the
contract between the Sites and the User. As such, they must be accepted by the
User. By browsing the Sites, regardless of the technical means of access and
the terminals used, the User is presumed to be aware of and unreservedly accept
these T&Cs. The T&Cs apply, as necessary, to any variation or extension
of the Sites on existing or future social networks.
GIC reserves the right to unilaterally
modify the T&Cs at any time and without prior notice in order to comply
with all legal, editorial and/or technical developments and due to the evolving
nature of the products and services offered by GIC which may be subject to
modifications. The T&Cs applicable to the User are those in force at the
time of browsing the Sites.
Article 2. Access and Availability of the Sites
GIC has implemented the technical
means to ensure the quality of service of the Sites. However, it is an
obligation of means that inevitably takes into account possible technical
hazards as well as cases of force majeure which cannot be subject to the
responsibility of GIC.
The Sites are accessible 24 hours
a day, 7 days a week, except in the event of force majeure or the occurrence of
an event beyond the control of GIC and subject to possible breakdowns and
maintenance interventions necessary for the proper functioning of the Sites.
The Sites are accessible free of
charge to any User with an internet connection, it being specified that the
costs relating to the User's internet connection are exclusively his/her
responsibility as well as the equipment allowing to benefit from this
connection (computers, telephones, software, etc.).
The User is solely responsible
for the proper functioning of his/her equipment and internet access.
Article 3. Your GIC Customer Account
GIC makes available to users of
the Site …………………………………………..a GIC account. This account allows the User to have
access via a unique identifier to the products or services subscribed by the
User via the Site.
The connection to the account by
the User is done through the email address provided by the latter in the
subscription form and with a password validated by the User.
In order for his/her account to
be definitively activated, the User undertakes to accept these T&Cs and to
complete the entire subscription form with accurate, up-to-date, complete
information on his/her identity and not infringing the rights of third parties.
He also undertakes not to use a false identity or identity theft.
It is the User's responsibility
to update all the information concerning him/her indicated on his/her account.
Failing this, GIC reserves the right to suspend the User's access to the
products or services subscribed to and accessible via their account.
The User acknowledges that
his/her login credentials are strictly personal and guarantees their
confidentiality.
The User will have access to
his/her GIC account as soon as his/her subscription is done.
Article 4. Intellectual property
The Website and its contents are
protected by copyright and other intellectual property rights under
international laws and such copyright and any other rights in the Website and
its contents are owned by or licensed to GIC.
The user may not use the contents
of the Website other than in accordance with this Agreement.
The user is authorized to use,
view, download, copy or print textual or graphic content of the Website if it
is only for his own legitimate personal and non-commercial use. The user are
not permitted to change, alter or delete any copyright, trademark or other
proprietary notices or any part of the contents of the Website.
All proprietary rights in any
trademarks and service marks including logos (“GIC”) or other trademarks appearing
on the Website are vested in and will continue to be vested in GIC, . Nothing
in this Website shall be construed as granting any license or right to use any
Trademark for any purpose whatsoever.
It is reminded that copyright
infringement constitutes an infringement of copyright punishable by legal
proceedings.
For the purpose of using any
software allowing access to the Sites, Users benefit from a limited,
non-exclusive, non-transferable, non-sub-licensable license. This license does
not include any rights for any use other than access to the Sites.
Article 5. Personal data
For any information regarding the
processing of your personal data by GIC, please refer to the Privacy
Policy - Protection of Personal Data.
Article 6. Responsibility
6.1 Responsibility of the User
All hardware and software
necessary for access to and use of the Sites remain the sole responsibility of
the User. They are therefore solely responsible for the proper functioning of
their equipment and their internet access.
In general, the User is also
responsible for:
• the use they make of the Site.
• any direct or indirect damage
of any kind whatsoever that may be suffered.
The User also undertakes to
comply with the legal and regulatory provisions in force and in particular
refrains from:
• impersonate a third party,
• intentionally communicate
false, erroneous or misleading content,
• hinder access to and the proper
functioning of the Sites,
• publish content of a racist,
xenophobic, anti-Semitic, homophobic, Holocaust denial, pornographic,
pedophilic, child pornographic or contrary to human dignity.
• publish content that incites
violence, suicide, terrorism, the use, manufacture or distribution of illegal
substances, or incitements to the commission of crimes or offences or that
glorifies them, in particular crimes against humanity,
• publishing content that is
insulting, defamatory, or infringes on the privacy, image or personality rights
of a third party, contrary to public order, the law or morality.
In the event of a breach of any
of the aforementioned rules, GIC may decide to remove the User's access to
his/her account, temporarily or permanently, without any prior compensation and
notification. GIC will also be able to claim compensation for the damage it may
have suffered as a result of this conduct.
6.2 Liability of GIC
GIC is committed to making its
best efforts to secure and ensure the security of the Sites and their content.
It shall use all reasonable means at its disposal to ensure access to the
Sites.
GIC shall not be liable for any
damages that may result from the use of the Site by the User in a manner that
does not comply with the T&Cs and the regulations in force and reserves the
right to suspend the User's access in the event of a breach of the T&Cs.
Article 7. Hyperlink
The Site may contain hypertext
links to other websites over which GIC has no control. Despite the prior checks
carried out, GIC declines all responsibility for the content that may be found
on these sites.
GIC authorizes the setting up of hypertext links
to any page or document on its Sites, provided that the establishment of these
links is not carried out for commercial or advertising purposes and that GIC
has expressly agreed to the establishment of this link.
GIC reserves the right to remove
a hypertext link to its Sites at any time if it deems it to be inconsistent
with its editorial policy.
Article 8. Partner & Advertiser Relations
The commercial relations, whatever they may be, that the User may maintain during the use of the site, with GIC's partners or with advertisers, are made directly with the partners or advertisers without GIC being a party to these relations. Therefore, GIC cannot be held liable for any damage suffered by the User as a result of its relationships with GIC`s partners or advertisers.
Article 9. Cookies
The Sites may use
"cookie" techniques to process statistics and traffic information,
facilitate navigation and improve the service for the User's convenience.

Article 10. Applicable law - litigation
These T&Cs are governed by the laws of the United Arab Emirates. They are written in English.
All disputes to which the T&Cs may give rise, concerning their validity, interpretation, execution or termination, their consequences and their consequences shall be submitted to the courts of Dubai.
